JOB RESPONSIBILITIES
Regulatory Compliance and Business Advice
- Keep up with changes in regulations and promptly notify and analyze them for the necessary departments to put into practice.
- Assist the company in negotiating complicated regulatory environments and offer expert guidance on regulatory compliance matters to ensure adherence to SBV legislation, internal rules, and industry standards.
- Take the lead in creating and revising internal policies, processes, and compliance plans to ensure they adhere to industry best practices and legal requirements.
- In order to properly identify and reduce any compliance risks, take part in the creation of the non-compliance risk matrix.
- Ensure that the Branch's AML/CTF framework is developed, implemented, and managed in accordance with Bank’s Group requirements as well as international and national regulations.
- Oversee the operation of the Name Screening Systems, Transaction Monitoring Systems, and Suspicious Transaction Reporting processes to detect and manage financial crime risks.
- Provide comprehensive training to staff on AML/CFT protocols, establishing a culture of compliance and alertness.
- Serve as the Branch's principal point of contact with regional and global regulators for AML/CTF-related issues.
- Create and implement a strong internal compliance structure and code of ethics to uphold the bank standard and promote an ethical culture across the whole organization.
- To promote an open and law-abiding corporate culture, make sure the branch has strong ethics guidelines, active monitoring protocols, and solid data privacy safeguards.
- To find areas that need improvement and put remedial actions in place, conduct evaluations and assessments of internal compliance.
- Liaise with the SBV and other relevant regulatory bodies to ensure timely submission and compliance with all license requirements.
- When necessary, coordinate legal opinions and regulatory matters with outside law firms, making sure that local laws and international standards are followed.
- To ensure that operational documents in the banking industry comply with internal policies and Vietnamese legislation, oversee the legal evaluation of these documents. This includes facility agreements, mortgage agreements, and other contracts pertaining to collateral.
- Arrange for legal opinions to be provided in coordination with outside law firms, especially in matters that are complex and include banking operations, regulatory changes, or conflicts.
- Oversee the internal legal review procedure for significant banking agreements, collaborating closely with business divisions to guarantee that agreements, contracts, and legal papers are compliant with the bank's risk management policy and regulatory standards.
- Monitor the adherence of legal documents to banking best practices and regulatory standards, ensuring the branch complies with the law.
- Assist the Compliance Department team in developing their skills and knowledge consistently by serving as their leader and mentor.
- Oversee the department's training initiatives, planning seminars on risk management techniques, compliance issues, and regulatory updates for all staff members.
Skills requirement
- Strong grasp of international banking standards and SBV laws, with an emphasis on risk management, AML, and compliance.
- Strong written and verbal communication abilities in Vietnamese and English; fluency in French is a bonus.
- Advanced proficiency with Word, Excel, and PowerPoint in Microsoft Office.
- Excellent managerial, problem-solving, and organizational abilities, as well as a track record of team leadership.
- Elevated standards of accountability, professionalism, and moral behavior.
- Bachelor's or master's degree in finance, law, or a comparable discipline (preferably with a background in law). Having a CAMS degree is preferable
- 10 years or more of experience in the financial sector in compliance, AML/CTF, and risk management, with at least 05 of those years spent in management.
- A track record of successfully managing regulatory interactions, creating compliance frameworks, and collaborating closely with SBV and other supervisory agencies.
